Guarantees

According to European legislation, the Seller guarantees the conformity of the goods sold for a minimum period of 2 years from delivery. Therefore, the seller is required to ensure that the goods purchased have the quality, functionality or characteristics promised or reasonably foreseeable for at least two years from the time of delivery to the buyer.

If Users act as European Consumers, the legal guarantee of conformity of the goods applies to the items available on www.theloft.store in accordance with the laws of the country in which they habitually reside.

The national laws of that country may grant such Users broader rights.

Consumers who are not acting as European Consumers may have conformity guarantee rights under the law of the country in which they habitually reside.

All products sold are covered by the "Legal Guarantee" of Conformity provided for by articles 128-132 of the Consumer Code.

The Sellers are always solely and directly responsible for production defects or discrepancies and for the warranty obligations established by law. Both in the case of sale by TheLoft.store and by a Seller, the warranty on the product will be exercised in the manner and within the times established by law directly by the Seller.

By virtue of the "Legal Guarantee" the Seller is responsible for defects of conformity that appear within 2 (two) years from Delivery of the Product.

The legal guarantee requires that the Consumer, under penalty of forfeiture, report to the Seller any lack of conformity found in the product purchased within 2 (two) months of discovery (art. 132, Consumer Code). Following this complaint, the Consumer will have the right to request the repair or replacement of the Product, without prejudice to the other rights provided by law in favor of the Consumer.

Products repaired, modified or in any way altered by the user are excluded from the Legal Guarantee. Also excluded from the scope of the Legal Guarantee are any failures or malfunctions or defects of any other type caused by accidental events or the responsibility of the Consumer or by use of the product that does not comply with its intended use and/or as provided in the technical documentation. attached to the product, where existing, or in the instructions for use relating to the same.

Even the Non-Consumer Customer, as defined in the art. 3 of the Consumer Code, can avail of the legal guarantee right provided for in the Civil Code. The legal guarantee in this case is valid for a maximum of 12 (twelve) months from delivery of the Product and provides, under penalty of forfeiture, the communication to the Seller of any defect found in the purchased product within 8 (eight) days of discovery. .

In order to take advantage of the Guarantee, it is necessary to keep the purchase document and the relevant tax documentation.
